The Contractual Affairs Subcommittee (CAS) is dedicated to the development, review, and management of contractual standards and practices within the construction and project management industry, currently focusing on the development of the General Conditions of Contract (GCC) 2024.
The subcommittee, which consists of experts in various suites of contracts such as NEC, FIDIC, and JBCC, as well as SAICE Arbitrators, Adjudicators, and Amicable Settlement Facilitators, leads the drafting, review, and refinement of contractual documents to ensure they are clear, fair, and comprehensive, aligning with current industry practices and legal standards. These experts bring a wealth of knowledge and experience.
The subcommittee engages with a broad range of stakeholders, including industry professionals, legal experts, and government representatives, through workshops and forums to gather input and feedback. It regularly reviews and updates existing contracts to maintain their relevance and effectiveness, incorporating stakeholder feedback and emerging industry trends.
Additionally, the CAS develops and delivers training programs and workshops to educate members and industry professionals on contractual matters, creating guidelines and manuals to assist in understanding and applying contractual terms. By providing expert advice and support on contractual issues, promoting best practices in contractual management and dispute resolution, the subcommittee significantly contributes to the competency and effectiveness of contractual practices in South Africa’s built environment. The CAS collaborates closely with other PMCD subcommittees and SAICE divisions, as well as external legal institutions and industry bodies, to enhance the quality and relevance of contractual documents.
Furthermore, it monitors the progress of contractual document development and review activities, ensuring adherence to timelines and objectives, and provides regular updates to the PMCD leadership. The mandate of the subcommittee is to develop comprehensive contracts, engage stakeholders, promote education and training, offer expert advice, foster collaboration, and ensure continuous improvement in contractual practices, thereby making a significant positive impact on the built environment in South Africa and supporting the overall mission of SAICE and the PMCD.
